Terms of Use
These Terms of Use ("Terms") govern your use of the Orilla website at orillahomes.netlify.app (the "Site") and the agent-matching service we offer through it (together, the "Service"). By using the Site or submitting a form, you agree to these Terms. If you do not agree, please do not use the Site.
1. What Orilla is — and isn't
Orilla is a referral service. We collect information about your home search and introduce you to a licensed South Florida real estate agent ("Partner Agent") who we believe is a good fit for your needs. Orilla itself is not a licensed real estate brokerage, does not list or sell property, does not draft contracts, and does not provide legal, financial, tax, or investment advice. Any brokerage services are provided to you by the Partner Agent under their own license and brokerage agreement.
2. Eligibility
You must be at least 18 years old and capable of forming a binding contract to use the Service. The Service is intended for people looking for rentals or homes in Florida. If you use the Site from outside the United States, you are responsible for complying with your local laws.
3. Information you provide
You agree that any information you submit through the Site is accurate, complete, and reasonably current. You are responsible for the content of any notes or messages you submit. Do not submit information that is unlawful, harassing, defamatory, or that infringes another person's rights.
4. Communication consent
If you submit a form and check the consent box, you authorize Orilla and the Partner Agent we match you to contact you at the phone number and email address you provide. This includes calls and text messages, including messages sent using automatic telephone dialing systems. Message and data rates may apply. You can opt out at any time by replying STOP to a text message or emailing hello@orillahomes.com. See our Privacy Policy for details.
5. No guaranteed results
We do our best to match you with a qualified Partner Agent and to do it quickly, but we do not guarantee that you will find a specific rental or home, that any particular listing will be available or offered at a particular price, that a Partner Agent will be available in every area, or that you and your matched agent will agree on a working arrangement. Market conditions, availability, pricing, and agent schedules are outside our control.
6. Third-party links and listings
The Site may include links to third-party websites, listings, or tools. We do not control those third parties and are not responsible for their content, accuracy, or practices. Use of any third-party service is at your own risk and subject to that third party's terms.
7. Intellectual property
The Site, including its design, text, graphics, logos, and the Orilla name and mark, is owned by Orilla or its licensors and is protected by copyright, trademark, and other laws. You may view and use the Site for your personal, non-commercial home search. You may not copy, modify, distribute, or create derivative works based on the Site without our prior written permission.
8. Acceptable use
You agree not to use the Site to: (a) submit false, misleading, or fraudulent information; (b) attempt to probe, scan, or test the vulnerability of the Site or bypass any security feature; (c) scrape, copy, or harvest data from the Site by automated means; (d) submit spam or malicious content; or (e) use the Service in any way that violates applicable law.
9. Disclaimer of warranties
The Site and Service are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, Orilla disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components, or that any information on the Site is accurate or current.
10. Limitation of liability
To the fullest extent permitted by law, Orilla and its owners, employees, contractors, and Partner Agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or relating to your use of the Site or Service, whether based on contract, tort, statute, or any other legal theory, even if we have been advised of the possibility of such damages. Our total aggregate liability to you for any claim arising out of or relating to these Terms or the Service will not exceed one hundred U.S. dollars ($100).
Nothing in these Terms limits any liability that cannot be limited under applicable law.
11. Indemnification
You agree to indemnify and hold harmless Orilla and its owners, employees, and contractors from and against any claims, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Site, your violation of these Terms, or your violation of any law or the rights of a third party.
12. Governing law and venue
These Terms are governed by the laws of the State of Florida, without regard to its conflict of laws rules. Any dispute arising out of or relating to these Terms or the Service will be brought exclusively in the state or federal courts located in Miami-Dade County, Florida, and you consent to the jurisdiction of those courts.
13. Changes to these Terms
We may update these Terms from time to time. When we do, we will change the "Last updated" date at the top of this page. Your continued use of the Site after an update means you accept the updated Terms.
